A warranty is generally defined  as “An assurance by one party to a contract regarding the existence of a fact upon which the other may rely.”  Behind this simple definition lies a lot of confusion and misunderstanding, with regard to what a contractual warranty obligation actually means within construction subcontracts.  So, what does a warranty really obligate the subcontractor to do, and for how long?  This program will provide you with an opportunity to better understand:

Ms. Behrendt was admitted to practice in Minnesota in 1989, the District of Minnesota Federal Court in 1991 and before the United States Court of Appeals in 1994. Upon admission to the bar, Ms. Behrendt clerked for U.S. Magistrate Judge Franklin L. Noel, United States District Court in Minnesota. As a partner with the Stich Angell firm, Ms. Behrendt’s practice focuses on motions and appeals in both state and federal court on a variety of issues including construction law, premises liability, and employment discrimination. Ms. Behrendt is an accomplished and experienced appellate practitioner, with involvement in multiple appeals in the Minnesota appellate courts as well as the Eighth Circuit Court of Appeals, including representation of L.H. Bolduc, Co. in the seminal contractual indemnity case of Engineering and Construction Innovations, Inc. v. L.H. Bolduc Co., Inc., 825 N.W. 2d 695 (Minn. 2013) and representation of Hallmark Homes in Rosso v. Hallmark Homes of Minneapolis, 843 N.W. 2d 798 (Minn. Ct. App. 2014), in which the Court of Appeals construed the meaning of the term “substantial completion” with reference to the ten-year statute of repose applicable to construction defect claims. She is also an Adjunct Professor at the William Mitchell College of Law, where she teaches Appellate Advocacy. She is presently the Chair of the Amicus Curiae Committee of the Minnesota Defense Lawyers Association, and from 2008 through 2012 was involved in the Minnesota State Bar Association’s “Wills for Heros” program, drafting wills, powers of attorney and health care directives for Minnesota police officers and fire fighters.
